Terms of Service

These Terms of Service ("Terms") govern your use of the website nightowlslc.com and the purchase of any products or tickets from Night Owl Ventures LLC ("we," "us," or "our"). By accessing our site or making a purchase, you agree to be bound by these Terms.

 

1. General Website Use

  • Ownership: All content on this site, including logos, event names, graphics, and merchandise designs, is the exclusive property of Night Owl Ventures LLC. You may not use, reproduce, or distribute any content without our express written permission.

  • Accuracy: We strive for accuracy but are not responsible if information on this site is inaccurate or out of date.

2. Merchandise Sales (Wix Store)

  • Eligibility: Merchandise is sold and shipped only within the United States.

  • Returns & Exchanges: We offer a 30-day return policy on physical merchandise. Items must be in original, unworn condition.

  • Return Shipping: The customer is responsible for all costs associated with shipping the item back to us.

  • Sales Tax: In accordance with Utah law, a sales tax of 8.45% will be applied to all orders shipped to Utah addresses.

3. Ticket Purchase Terms

  • Platform: Tickets are sold via TicketsCandy and processed by Square.

  • No Refunds: All ticket purchases are final and non-refundable, except in the case of a full event cancellation. Service and processing fees are strictly non-refundable.

  • No Chargebacks: You agree not to dispute or "chargeback" a legitimate transaction. We reserve the right to report chargeback fraud to credit agencies and seek recovery fees.

  • Media Release: By attending an event, you grant Night Owl Ventures LLC the irrevocable right to use your likeness in photos or videos for promotional purposes.

  • Entry Requirements: For 18+ or 21+ events, a valid government-issued ID is required. Failure to provide ID results in denied entry without a refund.

4. Payments

All payments for merchandise (via Wix) and tickets (via Square) must be made in full at the time of purchase. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.

5. Limitation of Liability & Risks

  • Event Risks: You voluntarily assume all risks associated with event attendance, including hearing loss (due to loud music), photosensitive seizures (due to strobe lighting), and exposure to infectious diseases.

  • Total Liability: To the fullest extent permitted by law, our liability shall not exceed the total amount you paid for the product or ticket in question.

6. Governing Law & Dispute Resolution

  • Governing Law: These Terms are governed by the laws of the State of Utah.

  • Arbitration: Any disputes arising from these Terms or your attendance at an event shall be resolved through binding arbitration in Salt Lake City, Utah, under the rules of the American Arbitration Association (AAA).
